Benefits During Maternity Leave

  • Flexible Working Regulations
  • Under the Employment Act 2002 (and more recently the Flexible Working (Eligibility, Complaints and Remedies) (Amendment) Regulations 2009), employees with children under the age of 17, or disabled children under 18, have a right to request flexible working arrangements. Under the Flexible Working Regulations (2006), eligible employees have the right to request flexible working to care for an adult in need of care.

  • Employees have the right to unpaid time off work in order to care for children who are their respsonsibility. This right exists until the child's fifth birthday, or 18th if the child is disabled.
  • Statutory Adoption Leave
  • Adopting parents have the right to paid leave in order to care for their new child. Adoption leave is available either to individuals who adopt, or to one member of a couple where a couple adopt jointly. The couple may choose which partner takes adoption leave, and the other member of the couple may be entitled to paternity leave and pay.

  • Statutory Maternity Pay
  • Statutory Maternity Pay (SMP) is payable to eligible employees who take maternity leave or leave employment because of pregnancy or childbirth.

  • Eligible fathers of newly born or newly adopted children have a statutory right to take paid paternity leave.
  • Statutory Paternity Pay
  • Fathers and couples who jointly adopt a new child are entitled to paid time off. This article sets out the criteria and obligations that need to be understood and followed.
  • Time Off For Dependants
  • All employees have the right to take a reasonable amount of time off during working hours in order to deal with an emergency involving a dependant.
